We read Chair Dave Brown’s statement that was sent to the Newberg/Dundee Community yesterday afternoon. We would like to issue a statement looking through a different lens.
In our knowledge of “jurisprudence”, which is defined as the study of law and the principles on which laws are based, the decision to fire Dr. Morelock “without cause” has potentially created more legal ramifications for the school district and community. Because even “without cause”, it is ill advised to fire an outstanding and well respected superintendent who was performing his duties and responsibility, as defined in Board Policy CBA, by using his educational expertise to protect the district from a poorly designed complaint-based policy that could potentially bring further financial and legal damage to the district as a whole.
Dave Brown is currently being sued personally for violating Oregon Public meeting laws to hire a partisan attorney on taxpayer’s dime. He himself is actively suing dissenting community members and is continually exposing NSD to potentially devastating lawsuits. Dave Brown has endangered the stability of Newberg and its school district, while showing a total lack of competence, preparedness and, worse, a lack of respect for students, parents, staff, and his own constituents.
Dave Brown stated in his message that “the process for identifying and hiring a superintendent has begun.” Again, in our knowledge of “jurisprudence”, this is blatantly illegal as per Board Policy BBAA, “An individual Board member exercises the authority and responsibility of their position when the Board is in legal session only. The affirmative vote of the majority of members of the Board is required to transact any business” (Policy BBAA).
Only the board as a whole can start such a process. The Board Chair cannot under any circumstances approach a candidate for a position that is not yet open and attempt to hire that individual or promise a job. However this does seem to have occurred according to Dave Brown’s own emails and a statement from Marc Theilman to KOIN news. Dave Brown has improperly and possibly illegally asked Marc Theilman if he would be interested in the job.
We do agree that the United States of America is now more divided than ever, and because of that all students should feel safe and protected in a school district that does not encourage division by discriminating against them based on their color, gender, race, political alignment, sexual preference or family background. Through his actions, Dave Brown and his right leaning cohorts are the adults who have brought and continue to force their politics and adult agendas into our school district.
We also agree that our community should stay informed and involved, and ask questions. Questions such as: How much is your illegally hired attorney costing the Newberg School District and taxpayers? Have you considered that enrollment is dropping due to your authoritarian, illegal tactics? Why do you choose to only listen to those in the community who support your viewpoints? Are you confused that a publicly elected official is held accountable by their constituents?
The bullying, hate and rough language are coming from inside the Board room and from the man who sits at the Chair.
We will get through this because we are Better Together. We will Recall Dave Brown and save the Newberg School District.
